Currently, two “same-as” bills are progressing through the New York State Senate and the New York State Assembly which, if signed into law, will enable plaintiffs who sue an out-of-state business to satisfy New York’s “long-arm” jurisdiction requirement merely by showing that the out-of-state business is registered to business in New York, regardless of whether the out-of-state business has ever conducted business or otherwise engaged in conduct in New York. As discussed in our memorandum, should the proposed legislation become state law, it would mark the broadest expansion of New York’s “long-arm” jurisdiction over out-of-state businesses in decades.
