New Bill Poses Major Overhaul of New York Law on Noncompete Agreements

In June 2023, the New York State Senate and the New York State Assembly passed counterpart bills which, if signed into law, will effectively ban almost all non-compete agreements for all workers in New York, regardless of their salary level or job function. The bill now awaits Governor Hochul’s signature.  As discussed in our memorandum,  should the proposed legislation become state law, it would arguably mark the most significant revamping of the legal landscape governing restrictive covenants in the employer-employee context in New York’s history.
