After Winning With-Prejudice Dismissal For Its Clients of Multimillion-Dollar Milberg Action, Wilk Auslander Presses Second Circuit to Affirm: Following Wilk Auslander’s victory on behalf of its clients in an arbitration in which Milberg sought almost $12 million in legal fees, Milberg filed a proceeding in the Southern District of New York seeking to vacate the arbitration award. The District Court dismissed the proceeding, with prejudice, due to lack of subject matter jurisdiction and the untimeliness of the proceeding. Milberg has appealed; Wilk Auslander, on behalf of its clients, has opposed.
